DMCA Policy

Buttermilk Waffles respects the intellectual property rights of others and expects its users to do the same. This DMCA Policy outlines our procedures for addressing alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on the Buttermilk Waffles website, please notify us by submitting a DMCA Takedown Notice as described below.

Filing a DMCA Takedown Notice

To file a DMCA Takedown Notice, you must provide a written communication that includes substantially the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, you may provide a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and where it is located on the Buttermilk Waffles website (e.g., URL link).

DMCA Counter-Notification

If your content has been removed from the Buttermilk Waffles website due to a copyright infringement claim, and you believe that the content was removed or disabled as a result of mistake or misidentification of the material, you have the right to submit a Counter-Notification. Your Counter-Notification must include substantially the following:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location (e.g., URL link) at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or a misidentification of the material to be removed or disabled.
  • Your contact information: Your full name, mailing address, and telephone number.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Buttermilk Waffles may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.

Please send your complete DMCA Counter-Notification via our Contact Us page, clearly indicating that it is a "DMCA Counter-Notification" in the subject line or message.

Upon receipt of a valid Counter-Notification, Buttermilk Waffles will send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored within 10 to 14 business days after receipt of the Counter-Notification.
